01. Agreement to these terms
By accessing or using the Services, you agree to these Terms of Service and our Privacy Policy. If you use the Services for an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Services.
02. Access and rate limits
Vireonix does not require accounts, registration, or API keys. Access is provided on a free, open basis subject to these terms and our rate limits. You are responsible for how you use the Services from your network and IP address.
You may not circumvent rate limits, automate access in a way that degrades the Services for others, spoof identity headers, or rotate through abusive proxy networks to evade limits. Ordinary deployment across legitimate application infrastructure is permitted, including for commercial resale under Section 04.
03. Free service and rate limits
The Services are provided free of charge. To keep the platform available for everyone, each IP receives hourly input and output usage budgets. Usage is displayed as a percentage:
- Auto is the only public model and uses a custom routing method to select the right upstream model; and
- Auto uses a 1x burn rate, permitting approximately 20,000,000 input tokens and 200,000 output tokens per hour at a full budget, with a context window of up to 1,000,000 tokens.
We may adjust limits, throttle, or block traffic that threatens stability or violates these terms. Exceeding limits may result in temporary HTTP 429 responses.
04. Commercial resale of AI inference tokens
You may charge your customers for access to an application, API proxy, platform, token-credit storefront, or other service powered by Vireonix. You may meter that access in AI inference tokens or credits, set your own retail prices, and accurately describe the metered units as “Vireonix AI tokens” or “Vireonix-powered AI tokens.” No separate written agreement is required for resale under these public terms.
In these terms, an “AI token” is a unit used to measure text processed or generated by a language model. It is not a cryptocurrency, security, stored-value instrument, ownership interest, or token issued for transfer on a blockchain. Vireonix does not currently sell or redeem prepaid balances; a reseller creates and administers its own customer credits and billing ledger.
If you resell access, you must:
- Comply with the same hourly limits and not hide, spoof, or rotate network identity to evade them;
- Maintain reasonable safeguards against abuse and require end users to follow restrictions at least as protective as Section 05;
- Clearly disclose, before use, that prompts, outputs, and related chat traces are sent to Vireonix and may be retained and used as described in our Privacy Policy, including for model training and improvement;
- Accurately represent model access, availability, limits, and token accounting without claiming that Vireonix is literally unlimited;
- Provide your own customer billing, refunds, support, authentication, metering, and legally required notices; and
- Not claim to be Vireonix, an exclusive distributor, or an endorsed partner unless we have agreed to that representation in writing.
Resale does not create reserved capacity, an uptime commitment, exclusivity, wholesale ownership of the underlying infrastructure, or a service-level agreement. Your upstream allowance is shared according to the technical rate-limit policy, and Vireonix may throttle or block abusive traffic. You are responsible for promises you make to your customers.
05. Use of the Services
You may use the Services to build, test, and operate applications in compliance with applicable law and these terms. You may not use the Services to:
- Develop or distribute malware, phishing, fraud, or other deceptive activity;
- Violate another person’s privacy, intellectual property, or other rights;
- Generate or facilitate illegal content or activity;
- Attempt to discover source code, bypass safeguards, or disrupt the Services; or
- Represent AI-generated output as human-generated where disclosure is legally required.
06. Your content and model output
You retain ownership of content you submit to the Services (“Input”), including prompts, messages, files, and other materials you provide through the API, Try interface, website, or related tools. As between you and Vireonix, and to the extent permitted by law, you own the resulting Output.
By using the Services, you grant Vireonix a worldwide, non-exclusive, royalty-free, perpetual license to use, store, process, reproduce, analyze, and create derivative works from Input, Output, and related chat traces (including conversation history, tool calls, metadata, and feedback) for the purposes of operating the Services, improving quality and safety, developing new features, and training, fine-tuning, evaluating, and improving our models and systems.
You represent that you have the rights needed to submit Input and to grant the license above, and that Input does not violate applicable law or third-party rights. Do not submit sensitive personal data, secrets, or confidential information you are not authorized to share for training and product improvement.
Because machine-learning systems are probabilistic, Output may be inaccurate or incomplete. You are responsible for evaluating Output before relying on it, especially in high-impact contexts.
07. Fees
The Services are free. We do not charge for ordinary use under these terms. We may introduce optional paid offerings in the future; any paid features will be clearly presented before you incur charges.
08. Service availability
We work to keep the Services reliable, but they may occasionally be unavailable or change. Preview features are provided for evaluation and may be modified or discontinued without notice. We may impose or change rate limits to protect the platform.
09. Termination
You may stop using the Services at any time. We may suspend or block access (including by IP) if you materially breach these terms, create security or legal risk, or abuse the free tier.
10. Disclaimers and liability
THE SERVICES ARE PROVIDED “AS IS” AND FREE OF CHARGE TO THE MAXIMUM EXTENT PERMITTED BY LAW. VIREONIX DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIREONIX’S TOTAL LIABILITY ARISING FROM THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNTS YOU PAID US (IF ANY) DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.
11. Changes and contact
We may update these terms to reflect changes to the Services or law. Material changes will become effective after reasonable notice. Questions may be sent to main@vireonix.ai.
